Holland Conservation Commission

Minutes of Commission meeting held on August 10, 2010.

Present: Mary vandenBerg, Chairperson, Marcia Beal, Patricia Caron, Nathan Gumlaw and James Wettlaufer.

Chairperson called the meeting to order. The minutes of the July 27, 2010 meeting were read and accepted and will be distributed.

Old Business:

Members signed the vender voucher paying for 3 signs which will inform Holland residents of the 319 Water Quality Management Grant to the Town of Holland at the following sites: Fenton Rd., Kimball Hill Rd., and Mashapaug Rd.

Mary vandenBerg reported having spoken to the Board of Selectmen and the DEP regarding the Kreiger/Balderelli pond.  The DEP recommended that a Notice of Intent be submitted by the Holland Fire Dept. and the Holland Highway Dept.; the former because they have a fire hydrant utilizing the pond, and the latter, because they maintain the culvert.

7:15 p.m.  Gary Barker of 11 Pine Tree Dr., Map R41-B-06 reviewed his Notice of Intent to repair and replace a concrete lakeside retaining wall that is caving into the lake.  He was informed that he must notify the abutters of the Public Hearing, which is scheduled for September 14, 2010 at 7:30 p.m.  He gave us a check paying the NOI filing fee to the Town.  

7:35 p.m.  Glen Anschutz of 30 Old Acres Rd., Map R23-B-7 returned having decided to repair his waterfront wall with more rip rap rather than the versa-lock material.  He presented a landscaping design plan by Earthwork Landscaping.  Motion was made by Nathan Gumlaw to accept the project.  All were in favor of the project and Mary vandenBerg signed the Procedure Sheet.  He also said, because of the severe storm water erosion, he would like to get an estimate to install catch basins at the end of Old Acres Rd., which is a private Rd.  He was informed a Notice of Intent would be required.  

8:00 p.m.  Mr. and Mrs. Mark Matti of 5 Water Front Way, formerly 5 Robert Rd. presented a diagram of their proposed project to replace their above ground water line to the shallow well and placing the line 3 to 4 feet underground, cutting down a 8 inch diameter pine and removing poison ivy around the house and installing a septic system.  Mary vandenBerg made a motion that the pine tree could be removed, leaving the stump, and removal of the poison ivy. All were in favor of that project.   They were informed that they need to present a scaled drawing of their well project.  An engineer would have to design the septic system.  

8:15 p.m.  Mr. James Wettlaufer received an Administrative Consent Order with Penalty regarding the violations involved in the work at Mashapaug Rd., across from PJ’s., by the Holland Highway Dept. which resulted in alteration to jurisdictional resource area.
 
A.      “Within thirty (30) days of the effective date of this Consent Order, Respondent (Board of Selectmen) shall pay to the Commonwealth one thousand dollars ($1,000.00); and



B.      “MassDEP agrees to suspend payment of the sum of ten thousand dollars ($10,000.00); provided, however, that if Respondent violates any provision of this Consent Order, or further violates any of the Regulations cited in Part II above within two years of the effective date of this Consent Order, Respondent shall pay to the Commonwealth the remaining amount of ten thousand dollars ($11,000.00) within thirty (30) days of the date MassDEP issues Respondent a written demand for payment.”

“The Respondent shall perform a Supplemental Environmental Project that consist of preparing a full day seminar directed at municipal department of public works staff and Conservation Commissioners and General Contractors who perform work under the Massachusetts Wetlands Protection Act, MGL chapter 131, section 40 (the “ACT”).”  

Motion was made by Mary vandenBerg to accept and pay the $1,000.00 fine.  Seconded and approved by all.

The meeting was adjourned at 8:40 PM.
